What would you do with a potential additional return of 15-25 percent on your past PIP claims?
Florida motor vehicle insurance laws require vehicle owners to purchase a minimum of $10,000 in Personal Injury Protection (PIP) coverage. PIP provides compensation to parties involved in a motor vehicle accident (excluding motorcycles) for resulting medical services. As a no-fault state, an accident victim can initiate their PIP benefits immediately, regardless of who is responsible for the accident.
Who Do the PIP Attorneys at SKG Represent?
After an accident, it is common for insured person to assign their PIP benefits under their applicable insurance policy to a medical provider in exchange for medical treatment. The PIP attorneys at The Schiller Kessler Group represent you, the medical providers of Florida who work tirelessly to better the lives and well-being of their patients.
The intricacies of PIP are complex. Insurers will often attempt to deny PIP claims based on a variety of reasons. These “defenses” employed by an insurer often lead to the reduction or even denial of PIP benefits for the insured.
One audit of your past files from our experienced PIP attorneys could possibly recover 15-25 percent in unpaid PIP bills. Florida PIP law requires bills to be paid within 30 days of submission to the auto insurance agency. If a bill is unpaid or underpaid past the 30-day threshold, it is considered overdue, giving you as the medical provider just cause to seek legal representation.
If your billings have been denied, reduced or simply unpaid with no justification on the Explanation of Benefits (EOB), you could have cause to file a PIP claim. Since the Florida statute of limitations for PIP suit recovery is five years from the date of filing, this means that you could potentially be owed more PIP benefits than were initially paid to you. This is where an audit by out PIP attorneys can potentially help you recover on average 15-25 percent in unpaid or underpaid PIP claims.
The PIP attorneys at The Schiller Kessler Group have litigated all issues relevant to PIP, including those commonly known in the PIP community and those which few, if any other, PIP attorneys have heard of. FAQ
How long does an audit of my files take?
An audit generally takes anywhere from a couple hours to a couple days. It really depends on whether the provider exclusively maintains hard copies of their files (which would need to be scanned) or electronic copies. Either way, we aim to make the auditing process as simple and painless as possible – we don’t want to create any additional work for our clients.
If you find a bill that has been underpaid or unpaid, what is the next step?
Once we have found a bill that has been underpaid or unpaid, we will take one of two steps. If we discover that the bill was underpaid/unpaid during an audit, we will send out a demand letter to the insurance company to see if we can resolve the issue. If the insurer replies to our demand letter, and the bills still remain underpaid/unpaid, we will determine the reason for underpayment/nonpayment and decide at that juncture whether we need to immediately file a lawsuit on behalf of the provider.
How long does the process from audit to demand letter to payment?
Once we have audited a provider’s office, we will try to have the file demanded within 48 hours. If we perform a very large audit and pull a significant volume of cases (100+), then it may take us a little bit more time to have them all sent out for demand. We have one of the fastest turnaround times of any PIP firm, but we really pride ourselves in our accuracy – we have never had a case dismissed for an improper demand letter.
